Terms & conditions.

Common sense first.

We're a small bakery in The Woodlands, Texas, run by real people. We treat everyone who walks through our door like a neighbor — because most of you are. We'd love to just shake hands, hand you a warm box, and call it good. The world we live in requires a few pages of legal language, so here it is. Be a good guest, we'll be a good shop, and none of us will ever need to read this page again.

1. General

By placing an order, walking into the shop, or using this website, you agree to these Terms. We reserve the right to refuse service to anyone for any lawful reason. Customers must be 18 or older to place online orders; minors are welcome in the shop with a guardian.

2. Pastry Orders

All pastries are made fresh, in small batches, the morning of pickup or delivery. Quantities are limited; same-day requests are filled subject to what's already coming out of the oven. Online orders are confirmed by email only after we've prepared and verified availability — appearing in the cart is not a guarantee of stock for that day.

3. Pickup & Delivery

Pickup is at our bakery in The Woodlands, Texas (Lake Windcrest / The Woodlands Country Club area) during posted hours; the exact address and pickup window are confirmed in your order email. Local delivery is available within fifteen (15) miles of our bakery — covering most of The Woodlands, Magnolia, Conroe, and Tomball — for a flat $25.00 delivery fee added at checkout, during a one-hour delivery window. Addresses beyond 15 miles cannot be accepted for delivery; if an order is placed for an address outside the delivery area, we will contact you to arrange pickup instead. We do not currently ship pastries outside of our local delivery area.

If a customer is not present to receive a delivery, we will attempt one redelivery the same day. If still unsuccessful, the order is forfeit; refunds are not issued for missed-delivery situations because the pastries cannot be re-sold.

4. Custom & Wedding Orders

Custom orders, wedding cakes, and large-format event trays require a non-refundable deposit at booking and a minimum 14-day lead time. Final flavor, design, and quantity must be confirmed in writing at least 7 days before the event. Once production begins, deposits are non-refundable; remaining balance is due before pickup or delivery.

5. Consultation Deposit

Private Calendar bookings — weddings, private households, country clubs, hotel programs, corporate gifting, and other custom events — begin with a $750.00 USD non-refundable consultation deposit, invoiced by Pastries de Paris through Square only after Ali Al Ghoul personally reviews and accepts the inquiry. The deposit pays for the consultation itself (in person at our Lake Windcrest kitchen in The Woodlands, or by video for out-of-state clients) and the preparation of a written proposal for your event.

The consultation deposit is non-refundable under any circumstances once it has been paid. This includes, without limitation: cancellation by the client, postponement of the event, change of venue, change of planner, change of mind, non-attendance at the consultation, withdrawal of the inquiry, or a decision not to proceed to a final booking after the consultation. There is no scenario in which the deposit is returned in cash, credit, or otherwise — except as required by applicable Texas or U.S. consumer law.

The client acknowledges that Pastries de Paris's services are unique and bespoke; that accepting a consultation reserves the personal time of Ali Al Ghoul and places the client's date under active consideration ahead of other inquiries; that preparation for the consultation and the written proposal begins in advance of the meeting; and that the losses Pastries de Paris incurs when a consultation is cancelled or abandoned are real but difficult to measure precisely. The $750 is the price of the consultation service itself — not a penalty, forfeiture, or estimate of damages.

For intimate one-off private events of four (4) guests or fewer, a reduced $250.00 USD consultation deposit applies, governed by these same terms in every respect — non-refundable once paid, credited in full against a confirmed booking within twelve (12) months.

If the client proceeds to a confirmed booking with Pastries de Paris within twelve (12) months of the consultation, the full $750 is credited line-by-line against the final event invoice. The deposit is therefore not lost if you book — only if you do not. Booking-stage deposits (typically 50% of the contracted amount, due at booking) are governed separately by the booking contract and are likewise non-refundable once production planning begins.

Before payment, the client completes a written acknowledgment of these terms — either electronically on our secure deposit page (where the client affirmatively checks each term, types their full legal name as an electronic signature under the U.S. E-SIGN Act, 15 U.S.C. § 7001, and is issued an acknowledgment reference number that is recorded with the date, time, and exact terms presented, and printed on the payment receipt), or by the one-page Consultation Deposit Acknowledgment attached as a PDF to a Square invoice. In either path, payment of the deposit constitutes the client's written acknowledgment of these terms and of the published Terms & Conditions in their entirety.

6. Allergens & Food Safety

Our kitchen handles wheat, eggs, dairy, soy, and tree nuts. Cross-contamination is possible despite our best efforts. We cannot guarantee any product is completely free of allergens. Customers with severe allergies should consult with us before ordering and accept the risk if they choose to consume our products.

Pastries are intended for same-day consumption. Storage beyond 24 hours, or in conditions outside refrigeration where required, is at the customer's risk.

7. Payments

We accept credit and debit cards via secure card processors. Card details are handled directly by our payment provider — we do not store card numbers. All prices are listed in U.S. dollars; applicable Texas sales tax is added at checkout.

8. Cancellations & Refunds

Cancellations of standard online orders received at least 24 hours before the pickup or delivery window will be refunded in full. Same-day cancellations cannot be refunded because production has begun.

Custom and wedding-order deposits are non-refundable once accepted. Quality issues — a broken box, spoilage on arrival, the wrong flavor — should be raised within 24 hours; we will replace the affected items or, at our discretion, issue a credit toward a future order.

9. Limitation of Liability

Our products are sold as-is. We make no warranties, express or implied, beyond what is required by applicable Texas and U.S. consumer law. Our maximum liability for any claim arising out of or relating to your order, the shop, or these Terms is limited to the amount you paid for the product or service that gave rise to the claim, or $50, whichever is less. We are not liable for indirect, consequential, or special damages.

Any claim must be brought within one year of the date the cause of action arose, or it is permanently barred. We are not responsible for delays or failures caused by events beyond our reasonable control (force majeure, transit strikes, supply chain issues, weather, public-health closures).

10. Indemnification

You agree to indemnify and hold harmless Pastries de Paris, its owner, employees, and contractors from any claim, loss, or expense (including reasonable lawyers' fees) arising from your use of our products or services, your breach of these Terms, or your violation of any law or third-party right.

11. Premises & Safety

By entering the shop, you assume the ordinary risks of a working bakery — wet floors, hot ovens, sharp tools behind the counter. Report hazards to staff. We are not responsible for personal property left on the premises. Children must be supervised. The shop is monitored by video for security.

12. Photography & Likeness

Customers may photograph their own pastries, the shop, and themselves. From time to time we photograph the shop and our customers for our own social media and marketing. By being on the premises, you consent to incidental appearance in such photos. If you'd rather not appear, tell us — we'll happily keep the camera elsewhere.

13. Intellectual Property

The Pastries de Paris name, logo, recipes, photography, copy, and website design are owned by Pastries de Paris and protected by United States and international intellectual property law. You may share photos of your pastries on social media (please tag us!) but may not commercially reproduce our images, copy, or branding without written permission.

14. Dispute Resolution

We hope it never comes to this. If a dispute arises, both parties agree to attempt good-faith resolution by direct contact first. If unresolved, disputes will be settled by binding arbitration in either Montgomery County or Harris County, Texas, at the sole option of Pastries de Paris, under the Commercial Arbitration Rules of the American Arbitration Association. These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Each party waives the right to a jury trial and to participate in any class action. The losing party in any frivolous claim shall pay the prevailing party's reasonable attorneys' fees.

15. Privacy

We collect only what we need to fulfill your order — name, email, phone, delivery address. We do not sell your data. We use it to process your order, send order-related communications, and (only if you opt in) the occasional update about new menu items. You may request access, correction, or deletion of your data at any time by writing to bonjour@pastriesdeparis.com. We respect applicable U.S. and Texas privacy laws.

16. Miscellaneous

These Terms are the entire agreement between you and Pastries de Paris regarding the subject matter. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. We may update these Terms; the most recent version will always be posted at this URL. Continued use of the shop or website after an update constitutes acceptance.
